What Factors Can Affect the Timeline of a Divorce Case in Texas?

Some cases wrap up in a few months, while others drag on for well over a year, and the difference almost always comes down to a handful of specific circumstances rather than anything random. If you’re preparing to file or already in the middle of a case, understanding what shapes the timeline can help you set realistic expectations and make smarter decisions along the way.

Here are five factors that can affect the timeline of a divorce case in Texas.

Whether the Divorce Is Contested or Uncontested

When it comes to Texas divorce, nothing shapes the experience more than whether both spouses see eye to eye on the major issues. The divorce process in Texas draws a hard line between uncontested and contested cases, and the timeline gap between those two paths can be massive. In an uncontested divorce, both spouses have already sorted out property division, child custody, support, and any other relevant matters before a judge ever gets involved – the court simply looks over what the parties have agreed to and signs off. That level of cooperation means a case can close the moment the mandatory waiting period expires, often with minimal hearings and far less attorney time. Contested divorces work in the opposite direction. Every disputed issue – the family home, retirement accounts, a custody schedule, turns into its own battleground, demanding discovery, negotiation, and frequently a trial. These cases routinely run one to two years, and particularly tangled matters can stretch even further depending on what’s at stake and how willing each side is to deal honestly.

The Mandatory 60-Day Waiting Period

Texas law imposes a 60-day waiting period from the date the divorce petition is filed before any final decree can be granted. This rule applies to virtually every case, contested or not. The law does provide limited exceptions. Cases involving a documented history of family violence can sometimes bypass this requirement. But for the majority of divorcing couples, those 60 days are non-negotiable. This waiting period is a floor, not a ceiling. Your case won’t automatically conclude at day 61. The actual finish line depends on everything else happening in the case simultaneously. What the waiting period does is set the earliest possible resolution date. If you and your spouse agree on everything quickly and your paperwork is in order, you could potentially finalize the divorce shortly after that 60-day window closes. Most cases, even straightforward uncontested ones, take a few months beyond that threshold simply due to court scheduling and the time it takes to prepare and review final documents properly before submission.

Child Custody and Property Disputes

Few things extend a divorce timeline faster than unresolved disagreements over children or major assets. Child custody disputes are particularly time-consuming because Texas courts are required by law to prioritize the best interest of the child, which means judges take these decisions seriously and don’t rush them. If parents can’t agree, the court may appoint a guardian ad litem to represent the child’s interests, order home studies, schedule multiple hearings, and require both parents to attend mediation before the case proceeds to trial. Each of those steps adds weeks or months to the process. Property disputes carry similar weight. Texas is a community property state, which means assets and debts acquired during the marriage generally belong equally to both spouses. But determining what counts as community property versus separate property, especially in longer marriages or cases involving business ownership, real estate, or large investments, often requires forensic accounting, business valuations, and expert testimony. These evaluations don’t happen overnight. The more complex and contentious the financial picture, the longer you should expect the case to take before a final resolution becomes possible.

Court Availability and Local Docket Backlogs

Your divorce doesn’t exist in a vacuum. It lands on a docket alongside dozens or even hundreds of other cases, and court availability in your county has a real, direct effect on how fast things can move. In high-population counties like Harris County, congested dockets mean that scheduling a contested hearing or trial can require waiting months for an open slot. Even routine matters – temporary orders, status conferences, mediation sessions – eat up time when the court calendar’s packed. That’s a big reason why cases needing multiple hearings drag on so much longer than those resolved in a single final appearance. Attorneys carry their own scheduling constraints too, and finding dates that suit both counsel, both parties, and the court at once adds yet another layer of delay. Smaller counties, or cases that move quickly toward mediation and settlement, often see faster turnarounds simply because there’s less competition for court time. You can’t control the docket, but keeping your side of the case organized and responsive at least prevents you from piling unnecessary delays on top of the ones you’re already stuck with.

Cooperation and Good-Faith Communication Between Spouses

The mindset both spouses carry into the process shapes the timeline more than most people expect. Cases where both parties communicate openly and respond promptly to requests for financial records, discovery materials, and scheduling tend to move considerably faster than those where one spouse stalls, conceals assets, or refuses to engage. Delay tactics – ignoring discovery requests, blowing deadlines, skipping court-ordered mediation – drive up time and cost for everyone, including the spouse using them. Courts do have tools to push back, such as sanctions and adverse inferences, but reaching those remedies still takes time. When both parties are willing to negotiate honestly, even across real disagreements, they can often settle through mediation and skip trial altogether. Mediation typically wraps in a single day; a successful session can transform a case that was heading for a multi-day trial into one that closes within weeks. Your willingness to engage constructively is one of the few factors in this process you actually get to control.
