Cycling and the Hidden Dangers: What Every Cyclist Should Know

by Impact Contributor
March 25, 2025
in Resource Guide, Rights

Short answers

  • Research indicates that the common causes of bicycle accidents in the US are collisions with vehicles, falls due to bad roads, and cyclist error.
  • It seems likely that remedies include compensation for medical expenses, lost earnings, and pain, in consultation with attorneys.
  • Evidence suggests the statistics are dire, with 966 deaths in 2021, mostly in urban areas.

The growth of cycling and the increased risks

Cycling has become an increasingly popular mode of transportation and recreation in the US, especially in cities like Los Angeles, New York and San Francisco, where it is promoted as an environmentally friendly and healthy choice. According to some studies, the number of bicyclists has increased significantly over the past ten years, but with that comes an increase in the number of accidents.

In 2021, 966 cyclists were killed in traffic accidents, the highest number since 1980, while an estimated 41,615 were injured. These accidents often have tragic consequences, from minor injuries to death, highlighting the need to understand the causes and legal options.

Common causes of accidents: Road hazards

Bicycle accidents can happen for a variety of reasons, but a few causes dominate. First, collisions with motorized vehicles are the most common and the most dangerous. According to research, drivers typically fail to notice bicyclists due to distractions such as using mobile devices, talking or being tired. Failure to follow the rules, such as not yielding at intersections, and speeding further increase the risk.

Second, falls due to road conditions are common, especially in urban areas where potholes, bumps and slippery surfaces (e.g., rain or ice) cause accidents. Third, cyclist errors, such as driving under the influence, using headphones or not wearing a helmet, contribute to around 15% of incidents, according to studies.

Bicycle accidents often stem from road hazards like potholes and slippery surfaces, vehicle collisions due to distracted drivers, or cyclist errors like not wearing helmets. These incidents can cause serious injuries, leaving victims overwhelmed. If you’ve been hurt in a bicycle accident, don’t hesitate to consult an experienced bicycle accident lawyer and let him help you secure compensation and navigate your legal options with confidence.

Statistics Show the Severity of the problem

Statistics indicate the seriousness of the problem. Studies have shown that 78% of fatal bicyclist crashes occurred in urban areas in 2021, while 22% were in rural areas. Alcohol was involved in 37% of fatal cases, which highlights the importance of prevention.

In California, one of the states with the highest number of cyclists, there were 252 fatal accidents in 2020, while in Florida the number of injuries was about 5,000, according to local reports from the California Office of Traffic Safety. This data shows that urban environments and inattention are key factors, especially during rush hours.

Causes of accidents

The most common causes include collisions with cars, where drivers often fail to notice cyclists due to distraction or speed. Falls due to potholes or slippery surfaces are also common, especially in urban areas. Bicyclist mistakes, such as riding under the influence or without a helmet, add to the risk.

Legal remedies

Cyclists are entitled to compensation for medical expenses, lost earnings and pain. The process involves reporting an accident, gathering evidence, and consulting with personal injury attorneys, with filing deadlines of 1-3 years, depending on the state.

Legal rights of cyclists: Protection and compensation

In the US, bicyclists are considered road users and have the same rights as motorists under federal and state laws. If a bicyclist is injured due to someone’s negligence, they can file a claim for damages, including medical expenses, lost earnings, pain and suffering, and property (bicycle) damage.

The system is based on the principle of “fault”, which means that it must be proven that another participant, usually the driver, was negligent. Most states use “comparative fault”, so if the cyclist is partially at fault, the compensation is reduced proportionally, e.g. in California for 30% if 30% responsible.

Table: Key statistics on bicycle accidents in the US (2021)

Category Number
Death cases 966
Injured cyclists 41,615
Urban accidents (percentage) 78%
Accidents involving alcohol (percentage) 37%

How to protect your legal rights

After an accident, the first step is to seek medical attention, even if the injuries are not obvious, because the medical report serves as evidence. Next, the accident should be reported to the police, as the police report contains details of the incident, including the identification of the participants and witnesses.

Photos of the scene of the accident, damage to the bike and injuries are crucial, as well as contact details of witnesses. Consulting with personal injury attorneys, who often work on a percentage of the fee (typically 33%), helps in understanding options and negotiating with insurers. Time limits for filing a lawsuit vary by state, usually from 1 to 3 years, so it’s important to act quickly.

The importance of security and legal knowledge

Bicycle accidents are common in the US, but with the right precautions and knowledge, the risk can be reduced. It is important that cyclists wear helmets, use reflectors at night and obey traffic rules, while drivers should be careful.

Understanding your legal rights, such as your right to compensation and what to do after an accident, is key to protection. Quick response and legal advice can ensure fair compensation, saving cyclists from financial burdens.
