A Law Degree Doesn’t Tell You What Kind of Lawyer You’re Hiring

by Hillary Latos
in Legal Rights

Every licensed attorney has met the same basic requirements to practice law, but that credential alone reveals surprisingly little about what it’s actually like to work with them. Communication style, experience, approach, and availability all vary enormously from one attorney to another.

That gap between credentials and actual fit matters more than people often realize when they’re searching for representation. Two attorneys can hold identical qualifications on paper while offering completely different experiences once someone actually becomes their client during a difficult situation.

That’s exactly why understanding what to look for in a lawyer matters so much, since the right fit depends on far more than confirming someone passed the bar and technically has permission to practice law.

Experience Means More When It Matches the Problem

Years in practice tell part of the story, but not the whole story. An attorney with decades of general experience isn’t necessarily well suited to a specific type of case if most of that experience lies in entirely different areas of law.

What matters more is relevant experience, meaning direct familiarity with the specific type of situation someone is actually facing. An attorney who regularly handles similar cases brings pattern recognition and practical insight that broader, less focused experience simply can’t replicate as effectively.

Asking directly about relevant case history helps clarify this distinction. General reputation or years practicing law overall matter less than whether an attorney genuinely understands the specific challenges involved in the particular type of case at hand.

Pay Attention to How the Lawyer Communicates

Legal processes can be confusing, and how an attorney communicates during that process matters enormously. Responsiveness signals how accessible someone will be throughout a case, while clarity determines whether explanations actually make sense to someone without a legal background.

Realistic expectations matter too. An attorney who provides honest, grounded explanations rather than overly optimistic promises tends to build a more trustworthy working relationship, one where clients genuinely understand what’s happening rather than simply hoping for the best outcome.

Willingness to answer questions thoroughly, without rushing or dismissing concerns, often reveals a lot about how an attorney will handle communication throughout an entire case. That pattern tends to become clear fairly quickly during initial conversations and consultations.

Ask Who Will Actually Handle Your Case

It’s not unusual for the attorney someone initially meets to not be the person handling most of the day-to-day work on their case. Associates, paralegals, and other support staff often play significant roles, sometimes becoming the primary point of contact throughout the process.

That arrangement isn’t necessarily a problem, but it’s worth understanding clearly from the outset. Knowing exactly who will actually manage communication and casework helps set accurate expectations, rather than assuming one specific attorney will personally handle every single detail.

Caseload matters here too. An attorney managing an extremely high volume of cases may have less individual bandwidth than someone with a more manageable caseload, which can directly affect responsiveness and the overall attention any single case actually receives.

The Fee Agreement Deserves More Than a Quick Signature

Fee arrangements, particularly contingency agreements, involve more nuance than they might initially appear to have. Understanding exactly how fees get calculated, and what percentage applies under different circumstances, matters considerably before agreeing to representation of any kind.

Case expenses represent another important consideration. Costs like filing fees, expert consultations, or investigative work sometimes get handled differently depending on the specific agreement, and understanding who’s responsible for what helps avoid confusion or surprises later in the process.

Reading the fee agreement carefully, and asking questions about anything unclear, matters more than simply trusting that standard language covers every relevant detail. A clear understanding upfront prevents misunderstandings that could otherwise surface later, at a considerably less convenient moment.

Conclusion

Choosing an attorney ultimately involves evaluating the actual person and practice behind the credentials, not just confirming that someone holds a valid law license. Experience, communication style, staffing, and fee structure all shape what working with that attorney will genuinely be like.

None of that gets captured by a diploma or a polished advertisement alone. Those things confirm baseline qualification, but they say little about fit, responsiveness, or whether a particular attorney’s approach actually matches what someone specifically needs during their situation.

Taking time to evaluate these factors carefully, rather than choosing based on credentials or marketing alone, tends to produce a considerably better working relationship throughout what can already be a genuinely difficult and stressful process.
